Court Case Won

The court case has been settled with the bond company. Over 10 companies and individuals have been awarded a split of the $12,500 contractors bond. For us that amounts to about 25% of the value of the lien placed on our property. Th remaining balance will come out of our pocket.

Be very careful when dealing with company.

when things go wrong like the economy and then you make it right later should you still be punished over and over?I think not,furthermore how would you like someone doing same to you?

Michael I agree with you. Please let us know when you have paid every single individual and company that you have defrauded. Please also let me know when you are ready to mail me a check to cover the mechanics lien on my property. We will adjust this page to show you do take responsibility for your actions and have learned your lesson.

Mechanics Lien Placed on our Home

We received a letter from the orange county clerk recorder a few months after. The letter stated that a mechanics lien was filed our home by the roofing supplier. I contacted the owner Mike Matusiak and was told to pay the suppliers myself. Mike was uncooperative and refused to help. I found out that he has also scammed other unsuspecting home owners as well. I quickly filed a complaint with the contractors state license board. The board was absolutely did nothing other then mentioning to file suit against the contractor or the bond. I called the bond and filed a claim. The claim is now in court and due to a number of claims against the bond the court will now split the amounts between all the claims.

The Actual Job

The job was done quickly in about three days. The work was clean and done right although the cost were high. We decided to go with a higher cost contractor due to the importance of the work.

We received a California Preliminary Notice from the roofing supplier stating that supplies were issued to A-1 Factory Direct Roofing. We assumed that the company would pay the supplier as we had paid them promptly for all of there work. We should have read the find print.

If bills are not paid in full for the labor, services, equipment, or materials furnished, a mechanic's lien leading to the loss, through court foreclosure proceedings, of all or part of your property even though you paid your contractor in full.

Our mistake was not requiring the signed release from A-1 Factory Direct roofing before we made the final payment. A-1 was paid in full and we were happy to have the roof finally fixed.

How I found A-1 Factory Direct Roofing

We found A1 Factory Direct Roofing through a contractor referral site called Service Magic. I signed up, let them know we needed roofing work done and soon we were sent emails from 4-5 local roofers bidding on the job. Service Magic verified all contractors were licensed and insured which automatically created a level of trust for us. We reviewed all customer reviews and generally all the roofers and good reviews. We accepted and received bids from all the roofers. Prices were similar and it came down to who we thought was the best company.

A-1 Factory Direct Roofing showed us additional commitment. They were local and excited about doing the job in there backyard. They sent us a note with a card claiming they would provide excellent service. There owner Mike Matusiak was a fast talking salesman who seemed like a nice guy initially made it sound like they were a great company. We signed the contract and agreed to get the roof done in 2007.
